The undersigned (“Customer”) leases from Jump & Laugh (“Jump and Laugh Inflatables ”) the inflatable unit(s) named below (the “Units”) at the date and time specified below.

Terms of Use

  1. There are risks, both known and unknown, using any inflatable or amusement device, including, but not limited to physical injury, emotional injury, distress, paralysis and even death.  The risk of serious injury from participating in inflatable activities, although minimal, does exist, as it does in all play and amusement activities.  The customer recognizes and understands that use of the equipment may involve inherently dangerous activities.
  2. The customer agrees to notify all participants, their parents or guardians of ‘Use at Own Risk” policy.  As the customer of the units, the safety of all participants shall be the customer’s sole responsibility.
  3. Adult supervision is required when participants are using the units.  The customer understands that Jump & Laugh Inflatables is not responsible for the supervision of participants while units are in use.
  4. The weight and participant capacity for units is listed on each unit and should be strictly followed.
  5. Jump & Laugh Inflatables recommends for safety that bounce house participants be 3 years of age or older and wet/dry slide riders should be 6 years of age or older.
  6. All participants must remove shoes, jewelry, keys, eyeglasses, and any other loose or sharp objects before entering the bounce house.  No additional toys such as balls should be brought into the units.
  7. For safety and cleanliness purposes, NO food, drinks, gum, “silly string”, confetti or smoking is allowed in or near the units. Units found with banned items or debris will result in a cleaning fee of $30.
  8. To avoid neck, back and other bodily injuries – no wrestling, flips or rough housing is permitted in, on or from units. Participants shall not jump from platforms onto the sliding areas, climb the netting or roofs or bounce against the sides or near the doorway of the units.
  9. Anyone with head, back, neck or any muscular-skeletal injuries or disabilities, pregnant women and others who may be susceptible to injury from falls bumps or bouncing are not permitted in the units at any time.
  10. Do NOT allow older children to jump with younger children.
  11. If the units lose power or begin to deflate during operation or there is any reason to stop the units’ use, the adult supervisor should immediately assist participants with safe evacuation from units.
  12. Units MUST be secured to the ground at all times to prevent tipping or injury.  At no time should the units be removed from installed location.
  13. Units should not be used in inclement weather including winds exceeding 20mph sustained, rain and thunderstorms.  If such weather occurs, the units should be evacuated and the blower turned off.
  14. Participants shall be kept away from the blower(s) used to inflate the units.
  15. Use common sense in supervising use of the units. If something does not look right to you stop the activity or occurrence immediately.
  16. Event location area must be flat, dry and clear of rocks or any other debris to ensure the safety of participants. A 20-foot overhead clearance is needed, as well as a 5ft or more perimeter around the units. It is the customer’s responsibility to clean area prior to set up.
  17. The customer assumes full responsibility for any damage or loss to equipment during contracted time
  18. The customer is responsible for providing power to operate blower units and water for the wet units.  A grounded 3-prong outlet can be used and must be within 100’ of the unit.  A 100’ hose can be used and must be within 100’ of the unit.
  19. In case of power failure at the specified set up address Jump & Laugh Inflatables is not responsible for any refunds.
  20. Jump & Laugh Inflatables is not responsible for any heat or sun-related injuries or illnesses, including sunstroke, sunburn, or dehydration. Nor is it responsible for fatigue, chill and/or dizziness.

Cancellation Policy

If Jump & Laugh Inflatables determines cancellations are necessary due to inclement weather such as precipitation, high winds or other acts of nature or other dangerous circumstances, your deposit will be fully refunded.   Jump & Laugh Inflatables reserves the right to cancel any reservation that may jeopardize safety.

Cancellations based on customer decision must be made at least 7 days prior to scheduled event to receive a refund (ex.  A Saturday event must be cancelled the prior Saturday or before to receive a full refund).  No refunds will be given once the units are delivered and accepted by the customer, even if inclement weather follows.

Payment Policy

A $50 per unit deposit is required at time of reservation.  The remaining rental fee balance is due at time of or before the installation of units.

Delivery Policy

Delivery is included in rental fee for events within 20 miles of Raleigh, NC.  A $2 per mile delivery charge is applied to rental fees for locations between greater than 20 miles of Raleigh, NC.

Jump & Laugh Inflatables shall use its best efforts to deliver the units at the start time stated below; however, Jump & Laugh Inflatables cannot guarantee that the unit will be delivered at exactly the start time. Jump & Laugh Inflatables shall not be responsible for any claims or damages in the event that the unit is delivered earlier or later than the start time.

The customer agrees:

  1. That he/she has fully read this Agreement and that he/she has been instructed about and fully understands the safe and proper use of the units. The customer shall observe all safety precautions contained herein, including, but not limited to, constant supervision of the participants.
  2. That he/she shall keep the units in the same condition as when received, ordinary wear excepted.
  3. That he/she has not made alterations or attachments to the units.

Indemnification; Release of liability.

The customer agrees that he/she will indemnify and hold Jump & Laugh Inflatables harmless from any liability resulting from the use of Jump & Laugh Inflatables equipment by the customer, his/her assigns, heirs, guests, invites or other persons using the equipment while in the customer’s possession.  Jump & Laugh Inflatables and its officers, employees and agents shall not be responsible for any injuries occurred during the use of the units.

 


Liability Waiver

We strive to provide a safe, clean and fun atmosphere for you and your child(ren).  PLEASE READ THE FOLLOWING carefully before signing this liability waiver.

Waiver and Release: On behalf of myself, my children and children in my care participating in activities provided by Jump & Laugh Inflatables, I acknowledge and agree to the terms and conditions of this waiver as identified below:

  1. I and the children in my care who will participate in any Jump & Laugh Inflatables activities are physically, mentally and emotionally fit to participate in such activities.
  2. Should I drop off my children or children in my care for teen night or party activities, I will inform them not to leave the Jump & Laugh Inflatables party area until I or my designated representative return to pick them up.  I will inform them to follow all rules of participation and will trust their judgment or the judgment or my representative in their safe participation.  I understand the Jump & Laugh Inflatables staff does not provide a sitting service and is not responsible in their safe participation.  I understand the Jump & Laugh Inflatables staff does not provide a sitting service and is not responsible for participant actions.
  3. Waiver and Release: Participant understands and acknowledges that this Release discharges Jump & Laugh Inflatables, from any liability or claim that the Participant may have against Jump & Laugh Inflatables with respect to any bodily injury, personal injury, illness, death or property damage that may result from Participants use and possession of Jump & Laugh Inflatables equipment.: Participant does hereby release and forever discharge and hold harmless Jump & Laugh Inflatables and its successors and assigns from any and all liability claims, and demands of whatever kind or nature, either in law or in equity, which arise or may hereafter arise from Participants possession and use of Jump & Laugh Inflatables equipment.
  4. Assumption of the Risk: There are risks, both known and unknown, using any inflatable or amusement device, including, but not limited to physical injury, emotional injury, distress, paralysis and even death.  The risk of serious injury from participating in Jump & Laugh Inflatables activities, although minimal, does exist, as it does in all play and amusement activities. Participant understands and acknowledges that this Release discharge Jump & Laugh Inflatables from injury, illness, death, or property damage resulting from the possession and use of Jump & Laugh Inflatables equipment.: Participant recognizes and understands that use of Jump & Laugh Inflatables equipment may involve inherently dangerous activities.
  5. Insurance:  Participant understands that insurance for liability, health, and medical or disability coverage in any way related to the rental of equipment under this agreement is the sole responsibility of Participant.
  6. Indemnification: Participant agrees that he/she will indemnify and hold Jump & Laugh Inflatables harmless from any liability resulting from the use of Jump & Laugh Inflatables equipment by Participant, his / hers assigns, heirs, guests, invites or other persons using the equipment while in Participants possession.
  7. Other: Participant expressly agrees that this Release is intended to be as broad and inclusive as permitted by laws of the State of North Carolina and that this Release shall be governed by and interpreted in accordance with the laws of the State of North Carolina. Participant agrees that in the event that any clause or provision shall not otherwise affect the remaining provisions of this Release which shall continue to be enforceable.

I HAVE READ THIS RELEASE AND WAIVER OF LIABILITY AGREEMENT, FULLY UNDERSTAND ITS TERMS AND FULLY UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS FOR MYSELF AND THOSE FOR WHOM I HAVE ASSUMED RESPONSIBILITY.  BY MY SIGNATURE, I FREELY AND VOLUNTARILY AGREE TO THESE TERMS.

Inclement Weather Policy

  1. If there is heavy rain we will not deliver or set the unit up on location.
  2. If there is light rain and the forecast is calling for clearing skies the unit will be delivered and set up on location. The unit is NOT to be used in the rain. It is required that the rain has stopped and the unit is wiped down before it can be used.
  3. If there are high winds, higher then 15 MPH, the unit can be set up but not inflated until the wind settles below 15 MPH. If the wind starts to pick up, the unit must be deflated and you must wait to inflate the unit until the wind settles down.
  4. If the temperate drops below 42 degrees the unit will not be delivered. If the temperature drops below 42 degrees while the unit is set up on location the renters are required to deflate the unit and not inflate the unit until the temperature rises above 42 degrees.

Rescheduling Policy

  1. If a rental is cancelled due to inclement weather, “Jump and Laugh” will do everything in their power to reschedule, for an alternate date, the unit that the renter has originally scheduled. If the unit can not be secured for the alternate date, another unit, if available, will be provided.
  2. The customer can reschedule their event date prior to 48 hours prior to delivery and transfer any money paid to the new event date.
  3. If the unit has been delivered and set up, no refunds will be giving. However depending on the circumstances the customer may be able to reschedule the rental for another date.

Payment Policy

A $50 per unit deposit is required at time of reservation.  The remaining rental fee balance is due at time of or before the installation of units.


Delivery Policy

Delivery is included in rental fee for events within 20 miles of Raleigh, NC.   A $2 per mile delivery charge is applied to rental fees for locations beyond 20 miles of Raleigh NC.
(Ex.  A rental 30 miles from Raleigh, NC would be charged a $20 delivery fee.)

All Jump & Laugh Inflatable units are delivered the morning of the rental date and picked up the evening of the rental date.

Jump & Laugh  shall use its best efforts to deliver the units at the start time stated in contract; however, Jump & Laugh cannot guarantee that the unit will be delivered at exactly the start time; many times the units will be delivered several hours prior to event start times. Jump & Laugh shall not be responsible for any claims or damages in the event that the unit is delivered earlier or later than the start time.
